These terms and conditions apply to all customers ordering on-line, by mail or by telephone with us, by using any of these methods to place your order with us, you agree and accept our terms and conditions.
1. GENERAL
1.1 We provide an honest and professional service at some of the lowest prices in the United Kingdom.
1.2 We will provide our customers this service in the most efficient and reliable manner possible.
1.3 We will be open in the way we conduct transactions and there will be no hidden extras, all charges will clearly be displayed.
1.4 It is important that all of our customers read, understand and satisfy themselves as to the full content and implications of our terms and conditions.
2. Ordering and Stock Availability
2.1 It is possible that at times products displayed on our web site may be out of stock, all items are offered on our web site subject to availability.
2.2 Any order placed for an out of stock item will result in us contacting you to provide you with an estimated time of delivery and to take your further instructions.
2.3 Any item advertised and then sold on our web site, as “special order” will not be accepted for a refund unless faulty, as this item will have been ordered specially for you and cannot therefore be resold.
2.4 We accept orders from our secure on-line store 24 hours a day, you may also telephone your order to us by calling 02380 235904 or by completing a hard copy manual sales form which are available upon request.
2.5 You must complete all fields of required information truthfully with correct and accurate information. We retain the right in some circumstances to request additional proof of identity and residential status. In this instance we will contact you by email or telephone to inform you what exactly we require and where possible we will provide the reasons for this request.
2.6 . When paying for your goods by Credit or Debit Card we will carry out authorisation checks. This may involve checking with your card issuer that the details you have provided match the details registered with the bank
3. Delivery
3.1 We use secure parcel couriers to deliver all items supplied by us, the level of service we select will depend on the size, value and quantity of the items.
3.2 There are occasions when third party couriers fail in their service standards, in these instances we will do everything in our power to resolve any issue that arises as a result, however we will not be held responsible for any loss, costs, damages, charges or expense caused.
3.3 We are at present not able to deliver products outside of the United Kingdom (this does not include Eire). Carriage to all destinations outside of the United Kingdom Mainland will be quoted for separately to those figures displayed on our web site for deliveries within the United Kingdom mainland.
3.4 The third party couriers we use are not insured to enter into your property to deliver goods, it is therefore important that you have somebody there to help you receive the goods. If the delivery driver decides to enter your property this arrangement is between you and him and is in breech of our terms and conditions, we will accept no liability for loss or damages as a result.
3.5 You must check all deliveries for there accuracy and condition, all defects and shortages must where possible must be written on the delivery note and you should obtain the drivers signature in support of your observations. You must notify us within 3 working days of any discrepancies or problems.
3.6 All orders will only be delivered to the address that the card used to purchase the goods, as is registered with the bank. We will not redirect any goods to another location under any circumstances.
3.7 If the couriers have attempted delivery in accordance with their terms of business but have been unsuccessful and have to return the items to us, we will charge you a 20% handling/restocking fee.
3.8 Any products sent to rural and isolated locations may take longer to deliver.
3.9 Where an item is of appropriate value we will charge you for additional insurance at the rate of 1% in the pound of the order value, this figure may be changed without prior notification. Deliveries containing incorrect products must be notified to us in writing no later than 3 days of delivery. We accept no liability for issues arising from deliveries or non-delivery after 10 days.
4. Display Accuracy
4.1 The sales marketing and web design team at Shopbyprice work very hard to ensure that minimal mistakes are made when listing and displaying goods on our web site, such work is undertaken on a daily basis.
4.2 Should a product description or price be listed incorrectly we reserve the right to refuse and or cancel orders received, we will contact you at the earliest possible opportunity to notify you of any problems or changes.
4.3 Pictures of products are for display purpose only and should not be relied upon as a true and accurate representation of the actual model being sold and should therefore be used solely as a guide.
4.4 Specifications and colours of products may change without prior notification.
5. Returns Policy 7-14 day
5.1 We work in line with the distance selling regulations 2000 and a result of this you are required to send a notice of your intention to cancel any order placed with us within 7 days of its receipt. This can be done by sending your email, which should display clearly your name, address, invoice number and the reason for the cancellation to returns@shopbyprice.co.uk.
5.2 If you choose to exercise your right to cancel under the 7 day regulation the ownership and title of the goods reverts to the supplier, exceptions to the right include software, cabinets and stands that have been assembled, these items will remain the property of the buyer and will be deducted from any subsequent refund.
5.3 The 7 & 14-day policy placing a level of responsibility on the consumer, you must take reasonable care of the goods both before and after the notice to return has been given. All goods must be returned in an “as new condition” suitable for resale. This includes all original manufacturers packaging and material, which must be intact and as new. Any goods that do not meet with this description in our opinion will be retuned to the consumer at their cost. All items that you return to us after first getting our acceptance is done so at your risk and cost. We charge a handling fee equivalent to 25% of the original order value in any case that requires us to return the items to you once we have received them under the 7&14-day policy.
5.4 For goods that have been purchased and developed a fault during the first 14 days of receipt, you will need to email us at faultygoods@shopbyprice.co.uk providing your personal details along with the product type and serial codes, date of purchase. We will then arrange for the goods to be collected and inspected, goods found to be not working in line with the manufacturers specification will be replaced or repaired. Goods that are discovered to be working in accordance with the manufacturers specification will be returned to the customer and a charge of £65.00 will be made, refusal by the customer to accept the goods back will result in an additional 25% handling charge being made.
6. Warranty & Guarantee
6.1 All products carry a manufacturers 12-month guarantee except in the case of consumable products, which carry a 3-month guarantee. Guarantees exclude faults by accident, neglect and misuse. Routine maintenance, tuning of channels, convergence and user interface configuration that are available within the users remit and are not covered under the manufacturers guarantee. All products found to be working will attract our standard handling fee as detailed in these terms and conditions.
6.2 Extended warranty cover is available on most products we supply at the time of purchase, these products are supplied a by a third party at attract additional costs and conditions. Please ask for details when placing your order. We advise you to take extended warranty out where possible for your own protection.
6.3 We offer policies from two suppliers, Domestic and general and Retra. Any claims made under policies purchased from either of these companies should be made to the relevant company directly, numbers can be found on this site or by sending an email to warranty@shopbyprice.co.uk.
6.4 Return to base warranty exists for nearly all products supplied by shopbyprice.co.uk, for a full list please contact us by emailing sales@shopbyprice.co.uk.
7. Payment
7.1 Shop by price retains title on all goods until paid for in full.
7.2 Shop by price accepts most credit and debit cards, Amex is accepted but an additional 2% will be charged. Cheques and Bacs transfers require a minimum of 6 working days for clearance. We reserve the right to charge a 2% fee for accepting credit card payments.
7.3 When ordering with Shop by price you must provide us with your exact billing address and telephone number as it is held with the credit or debit card supplier. Incorrect information will result in delays and the possible decline and cancellation of your order.
7.4 Title of goods passes to the purchaser as soon as satisfactory delivery to the purchaser has been completed, all communication will only be conducted with the purchaser.
7.5 All prices unless otherwise stated are inclusive of value added tax at the current rate of 17.5%, this rate may change without prior notice.
8. Data Protection
8.1 In the course of our business dealings with you we collect personal and sensitive information about you, this information is collected lawfully and in accordance with the data protection act 1988.
8.2 We do not sell our data to third parties for any reason. It is only ever passed to third parties involved in the original transaction between us, such as delivery companies and bank clearance companies.
8.3 We use your email address as given for future marketing of our products and special offers that we think maybe suitable for you, if at anytime now or in the future you do now wish to receive such emails, you need to send an email with your name and address to optout@shopbyprice.co.uk.
8.4 Where we have sufficient believe that fraud is being perpetrated we shall pass those details that are relevant onto other businesses, fraud databases and the police.
9. Complaints Procedure
9.1 In the unlikely event that you feel the need to complain about any aspect or person that you have had dealings with during your contact with shop by price, you should send an email to customercomplaint@shopbyprice.co.uk. We will assign a senior member of staff who will deal with your complaint with 48 hours or sooner where possible.
